第九条/不当性行为

The right to report sexual misconduct to the 大学 without discouragement and the 有权得到及时、公平和公正的调查;

受学院官员尊重的权利;

The right to preservation of privacy, to the extent possible and allowed by law;

The right to be informed of available resources such as counseling, medical, mental health, law enforcement, immigration, or services for victims/respondents, both on 校园和社区;

The right to be fully informed or f the sexual misconduct policy and process as described 性行为不端政策;

The right to petition that any investigator, coordinator, or 大学 administrator 因明显的偏见而被排除在评选过程之外;

The right to be provided timely access to review relevant documents or materials, 受州和联邦法律规定的隐私限制;

The right to identify and ask the investigator to question relevant witnesses;

The right to have a representative or advisor present (although not directly participating) 在与调查员、协调员或上诉机构的任何会议期间

The right to be informed in writing of the outcome and sanction of any investigation 涉及性行为不端的;

The right to a finding and sanction (if any) based solely on evidence presented during 调查;

The right to appeal the finding and sanction of the applicable administrator, in accordance 与TSUS的不当性行为政策;

The right to have 大学 policies and procedures followed without material deviation;

The right to be informed in advance, when possible, of any public release of information 关于投诉.

The right to be informed by 大学 officials of options to notify proper law enforcement authorities, including on-campus and local police, and the option to be assisted by 通知学校主管部门.  这也包括正确的不 报告，如果这是受害者的愿望.

The right to notification of and option for interim safety measures such as changing academic and living situations after an alleged sexual assault incident, if requested and if changes are reasonably available (no formal complaint, or investigation, campus 或犯罪，需要在此选项可用之前发生).  住宿可能包括:

  • Reassignment of work location; Escort or transportation assistance.

The identity of the following individuals is confidential and not subject to disclosure under the Texas 公共信息 Act, unless such individual(s) waive nondisclosure 写作:

• a person who participated in 正规靠谱赌博软件’s investigation of such an incident; or,

• 正规靠谱赌博软件, as necessary to conduct an investigation and resolution of 调查;
• the person or persons alleged to have perpetrated the incident of sexual misconduct, 在其他法律规定的范围内;

• potential witnesses to the incident, as necessary to conduct an investigation; or,
• a health care provider in an emergency situation, as determined necessary by the 正规靠谱赌博软件.

If there is a direct conflict between the requirements of FERPA and the requirements of 第九条, such that enforcement of FERPA would interfere with the primary purpose of 第九条 to eliminate sex-based discrimination in schools, the requirements of 第九条优先于任何与FERPA条款相冲突的条款.
